BesD responds to Bundesrat<\/h2>\n\nOn April 11th<\/sup>, 2014, the Bun\u00addes\u00adrat, the Upper House of the Ger\u00adman Par\u00adlia\u00adment, cal\u00adled for an objec\u00adti\u00adve deba\u00adte and dif\u00adfe\u00adren\u00adtia\u00adted mea\u00adsu\u00adres to regu\u00adla\u00adte pro\u00adsti\u00adtu\u00adti\u00adon and sex busi\u00adnesses, fol\u00adlo\u00adwing a pro\u00adpo\u00adsal by the Saar\u00adland, one of Germany\u2019s six\u00adteen fede\u00adral sta\u00adtes.\n\nAccor\u00adding to the Bun\u00addes\u00adrat, the public deba\u00adte about pro\u00adsti\u00adtu\u00adti\u00adon is fre\u00adquent\u00adly affec\u00adted by pre\u00adju\u00addi\u00adces, a lack of know\u00adledge and sen\u00adsa\u00adtio\u00adna\u00adlism. The Bun\u00addes\u00adrat found no solid evi\u00addence sup\u00adport\u00ading the cla\u00adim that human traf\u00adfi\u00adcking in Ger\u00adma\u00adny had increased and it con\u00adfirm\u00aded that the num\u00adber of repor\u00adted cases had actual\u00adly decreased despi\u00adte an increase in poli\u00adce inves\u00adti\u00adga\u00adti\u00adons. The Bun\u00addes\u00adrat also rejec\u00adted the blan\u00adket equa\u00adti\u00adon of human traf\u00adfi\u00adcking and pro\u00adsti\u00adtu\u00adti\u00adon and empha\u00adsis\u00aded the pro\u00adtec\u00adtion of pro\u00adsti\u00adtu\u00adti\u00adon under Artic\u00adle 12 of the Ger\u00adman Basic Law (GG), which gua\u00adran\u00adtees the free\u00addom to choo\u00adse one\u2019s occu\u00adpa\u00adti\u00adon. At the same time, it cal\u00adled for fur\u00adther mea\u00adsu\u00adres to pro\u00adtect vic\u00adtims of human traf\u00adfi\u00adcking, e.g. by gran\u00adting them the right of resi\u00addence.\n\nFur\u00adther\u00admo\u00adre, the Bun\u00addes\u00adrat dee\u00admed the intro\u00adduc\u00adtion of a law to cri\u00admi\u00adna\u00adli\u00adse cli\u00adents an unneces\u00adsa\u00adry and coun\u00adter-pro\u00adduc\u00adti\u00adve mea\u00adsu\u00adre. On the one hand, \u00a7 138 of the Ger\u00adman Cri\u00admi\u00adnal Code (StGB) alre\u00ada\u00addy pro\u00adhi\u00adbits kno\u00adwing\u00adly taking advan\u00adta\u00adge of the plight of traf\u00adfi\u00adcking vic\u00adtims, and on the other hand, the poli\u00adce actual\u00adly recei\u00adves a con\u00adsidera\u00adble num\u00adber of tip-offs in regards to human traf\u00adfi\u00adcking from cli\u00adents them\u00adsel\u00adves.\n\nThe Bun\u00addes\u00adrat also oppo\u00adsed the re-intro\u00adduc\u00adtion of man\u00adda\u00adto\u00adry health checks for sex workers, thus pay\u00ading tri\u00adbu\u00adte to the suc\u00adcessful pre\u00adven\u00adti\u00adve mea\u00adsu\u00adres by the Ger\u00adman AIDS Ser\u00advice Orga\u00adni\u00adsa\u00adti\u00adon and the local health aut\u00adho\u00adri\u00adties. Man\u00adda\u00adto\u00adry health checks repre\u00adsen\u00adted gra\u00adve inf\u00adrin\u00adge\u00adments of basic human rights, and the\u00adre was no evi\u00addence that they could halt the spread of sexu\u00adal\u00adly trans\u00admit\u00adted dise\u00ada\u00adses. In addi\u00adti\u00adon, the mea\u00adsu\u00adre could crea\u00adte the wrong impres\u00adsi\u00adon that other pre\u00adcau\u00adti\u00adons (e.g. con\u00addoms) were then unneces\u00adsa\u00adry. Sen\u00adsi\u00adble and effec\u00adti\u00adve, on the other hand, were the expan\u00adsi\u00adon of vol\u00adun\u00adt\u00ada\u00adry, anony\u00admous coun\u00adsel\u00adling ser\u00advices, which alre\u00ada\u00addy for\u00admed part of the Pro\u00adtec\u00adtion Against Infec\u00adtion Act (IfSG).\n\nThe Trade Asso\u00adcia\u00adti\u00adon Ero\u00adtic and Sexu\u00adal Ser\u00advices (BesD) wel\u00adco\u00admes the objec\u00adti\u00adve dis\u00adcus\u00adsion of the Bun\u00addes\u00adrat about pro\u00adsti\u00adtu\u00adti\u00adon and con\u00adfirms its assess\u00adment of the abo\u00adve men\u00adtio\u00adned points. Howe\u00adver, in light of the con\u00adtin\u00adued socie\u00adtal stig\u00adma\u00adtis\u00ada\u00adti\u00adon of sex workers, we con\u00adsider the reform plans of the Trade Regu\u00adla\u00adti\u00adon Act (GewO) and the Cri\u00admi\u00adnal Code (StGB) that were also men\u00adtio\u00adned in the reso\u00adlu\u00adti\u00adon as pro\u00adble\u00adma\u00adtic.\n\nThe Bun\u00addes\u00adrat cal\u00adled for an intro\u00adduc\u00adtion of sta\u00adtu\u00adto\u00adry per\u00admis\u00adsi\u00adons for \u201csex busi\u00adnesses\u201d. While it cor\u00adrect\u00adly iden\u00adti\u00adfied that to begin with, a defi\u00adni\u00adtio\u00adnal cla\u00adri\u00adfi\u00adca\u00adti\u00adon of the term \u201csex busi\u00adness\u201d is neces\u00adsa\u00adry, it did not rea\u00adli\u00adse that the legal defi\u00adni\u00adti\u00adon of the term \u201crelia\u00adbi\u00adli\u00adty\u201d is also extre\u00adme\u00adly insuf\u00adfi\u00adci\u00adent. A busi\u00adness can have its ope\u00adra\u00adting licence denied if an appli\u00adcant is dee\u00admed \u201cunre\u00adlia\u00adble\u201d. In case of doubt, this leads to a situa\u00adti\u00adon whe\u00adre an offi\u00adci\u00adal needs to make a dis\u00adcre\u00adtio\u00adna\u00adry decis\u00adi\u00adon. Espe\u00adci\u00adal\u00adly in a trade that is sub\u00adjec\u00adted to num\u00ade\u00adrous socie\u00adtal taboos and pre\u00adju\u00addi\u00adces, this crea\u00adtes incal\u00adculable entre\u00adpre\u00adneu\u00adri\u00adal risks. As a result, smal\u00adler busi\u00adnesses unable to afford taking legal action will be threa\u00adten\u00aded with clo\u00adsure. The impo\u00adsi\u00adti\u00adon of sta\u00adtu\u00adto\u00adry per\u00admis\u00adsi\u00adon requi\u00adre\u00adments for the gran\u00adting of ope\u00adra\u00adting licen\u00adces rai\u00adses simi\u00adlar con\u00adcerns.\n\nWe also vehe\u00admen\u00adt\u00adly reject the idea men\u00adtio\u00adned in the reso\u00adlu\u00adti\u00adon of intro\u00addu\u00adcing a regis\u00adtra\u00adti\u00adon of sex workers accor\u00adding to \u00a7 14 Trade Regu\u00adla\u00adti\u00adon Act (GewO). Sex workers are affec\u00adted by the moral con\u00addem\u00adna\u00adti\u00adon of pro\u00adsti\u00adtu\u00adti\u00adon: our occu\u00adpa\u00adti\u00adon is not soci\u00adal\u00adly accept\u00aded. An outing in con\u00adnec\u00adtion with busi\u00adness regis\u00adtra\u00adti\u00adons or brot\u00adhel con\u00adces\u00adsi\u00adons is inac\u00adcep\u00adta\u00adble for most sex workers. Many lead a dou\u00adble life out of their own free will or out of neces\u00adsi\u00adty to pro\u00adtect them\u00adsel\u00adves from the nega\u00adti\u00adve con\u00adse\u00adquen\u00adces of stig\u00adma\u00adtis\u00ada\u00adti\u00adon. Up until now, the tax regis\u00adtra\u00adti\u00adon was suf\u00adfi\u00adci\u00adent for us. We could trust upon the tax office not to dis\u00adc\u00adlo\u00adse our per\u00adso\u00adnal data. The Trade Regu\u00adla\u00adti\u00adon Act (GewO) lacks a cor\u00adre\u00adspon\u00adding safe\u00adty mea\u00adsu\u00adre.\n\nAs the Bun\u00addes\u00adrat admit\u00adted, the intro\u00adduc\u00adtion of the Pro\u00adsti\u00adtu\u00adti\u00adon Act (Pro\u00adstG) has led to an aut\u00adho\u00adri\u00adsa\u00adti\u00adon of the sta\u00adte poli\u00adce forces and to a grea\u00adter den\u00adsi\u00adty of poli\u00adce raids in \u201csex busi\u00adnesses\u201d. The\u00adr\u00ade\u00adfo\u00adre, it should be exami\u00adned to what ext\u00adent the legal regis\u00adtra\u00adti\u00adon of sexu\u00adal ser\u00advice pro\u00advi\u00adders and\/or \u201csex busi\u00adnesses\u201d might have the poten\u00adti\u00adal to under\u00admi\u00adne our fun\u00adda\u00admen\u00adtal right of invio\u00adla\u00adbi\u00adli\u00adty of the home under Artic\u00adle 13 of the Ger\u00adman Basic Law (GG). The urgen\u00adcy beco\u00admes appa\u00adrent that not only the term \u201csex busi\u00adness\u201d needs to be defi\u00adned, but the\u00adre also needs to be a legal dif\u00adfe\u00adren\u00adtia\u00adti\u00adon bet\u00adween run\u00adning a \u201csex busi\u00adness\u201d, mere\u00adly ren\u00adting out pre\u00admi\u00adses, and actual\u00adly enga\u00adging in pro\u00adsti\u00adtu\u00adti\u00adon, e.g. at a pri\u00adva\u00adte apart\u00adment.\n\nEspe\u00adci\u00adal\u00adly in light of the abo\u00adve, we are very con\u00adcer\u00adned over the pro\u00adpo\u00adsal to with\u00addraw the so-cal\u00adled land\u00adlord pri\u00advi\u00adle\u00adge in the Cri\u00admi\u00adnal Code (StGB). Ope\u00adra\u00adtors of sex busi\u00adnesses who might not do any\u00adthing other than ordi\u00adna\u00adry employ\u00aders \u2013 name\u00adly, giving work ins\u00adtruc\u00adtions to employees who are finan\u00adci\u00adal\u00adly depen\u00addent on them \u2013 are alre\u00ada\u00addy sai\u00adling clo\u00adse to the wind due to \u00a7 180a and \u00a7 181a of the Cri\u00admi\u00adnal Code (StGB). Put\u00adting land\u00adlords on the same level as them would mean to fur\u00adther push our trade towards cri\u00admi\u00adna\u00adli\u00adty. For inde\u00adpen\u00addent sexu\u00adal ser\u00advice pro\u00advi\u00adders it would then be more dif\u00adfi\u00adcult to rent sui\u00adta\u00adble pre\u00admi\u00adses to work in safe\u00adty and be in con\u00adtrol. On the con\u00adtra\u00adry, working in depen\u00addence on \u201cmidd\u00adle\u00admen\u201d would beco\u00adme more attrac\u00adti\u00adve again. To pro\u00adtect our inde\u00adpen\u00addence we the\u00adr\u00ade\u00adfo\u00adre not only reject to cri\u00admi\u00adna\u00adli\u00adse our cli\u00adents but all attempts to cri\u00admi\u00adna\u00adli\u00adse sex work in con\u00adnec\u00adtion with a reform of the Pro\u00adsti\u00adtu\u00adti\u00adon Act (Pro\u00adstG).\n\nWith regards to the sug\u00adges\u00adti\u00adon by the Bun\u00addes\u00adrat to stan\u00addar\u00addi\u00adse the age of con\u00adsent, we sup\u00adport a stan\u00addar\u00addi\u00ads\u00ada\u00adti\u00adon to 18 years of age. The well-meant approach to increase the age of con\u00adsent to 21 years of age mis\u00adses the point of the lived rea\u00adli\u00adties in our trade. Beg\u00adin\u00adners bet\u00adween 18 and 21 years of age would be denied access to safe work spaces, lea\u00adving them vul\u00adnerable to cri\u00admi\u00adnals and for\u00adcing them to work at loca\u00adti\u00adons wit\u00adhout pro\u00adtec\u00adtion from dan\u00adgers.\n\nPut\u00adting the age of con\u00adsent to 21 years of age, alre\u00ada\u00addy a rea\u00adli\u00adty under \u00a7 232 art. 1 sen. 2 of the Cri\u00admi\u00adnal Code (StGB), has led to the fact that a con\u00adsidera\u00adble num\u00adber of traf\u00adfi\u00adcking vic\u00adtims in Ger\u00adma\u00adny are Ger\u00adman citi\u00adzens who are clas\u00adsi\u00adfied as vic\u00adtims sole\u00adly becau\u00adse they are bet\u00adween 18 and 21 years old, wit\u00adhout the neces\u00adsi\u00adty of any form of explo\u00adita\u00adti\u00adon or vio\u00adlence having taken place.\n\nIn our view, equal tre\u00adat\u00adment under the law with other occu\u00adpa\u00adti\u00adons, inclu\u00adding the age of con\u00adsent, is the best means to pro\u00admo\u00adte the destig\u00adma\u00adtis\u00ada\u00adti\u00adon of sex work. In con\u00adtrast, legal excep\u00adti\u00adons, espe\u00adci\u00adal\u00adly in are\u00adas of cri\u00admi\u00adnal law, cement the par\u00adti\u00adcu\u00adlar per\u00adcep\u00adti\u00adon of sex work among the popu\u00adla\u00adti\u00adon. It pro\u00admo\u00adtes the for\u00adma\u00adti\u00adon and cul\u00adti\u00adva\u00adti\u00adon of myths and pre\u00adju\u00addi\u00adces, which are repea\u00adted over and over again to legi\u00adti\u00admi\u00adse the con\u00adtin\u00adued dis\u00adcri\u00admi\u00adna\u00adti\u00adon of sexu\u00adal ser\u00advice pro\u00advi\u00adders.\n\nAlter\u00adna\u00adtively, one could con\u00adsider inclu\u00adding the pro\u00adhi\u00adbi\u00adti\u00adon of dis\u00adcri\u00admi\u00adna\u00adti\u00adon based on one\u2019s choice of occu\u00adpa\u00adti\u00adon in the Gene\u00adral Equal Tre\u00adat\u00adment Act (AGG) or the reco\u00adgni\u00adti\u00adon of sex work as free\u00adlan\u00adce occu\u00adpa\u00adti\u00adon. Social insu\u00adrance struc\u00adtures for sexu\u00adal ser\u00advice pro\u00advi\u00addes could be desi\u00adgned accor\u00adding to the model of the Artist Social Fund (KSK).
